Limitation of Liability

Important Legal Information - Please Read Carefully

As a small family business, we must establish reasonable limits on our legal liability to remain financially viable while still providing excellent products and service. These limitations are standard in the industry and allow us to offer competitive pricing while maintaining quality craftsmanship.

These limitations do not affect your rights under consumer protection laws, product warranties, or our commitment to customer satisfaction. They simply establish reasonable boundaries for legal claims and potential damages.

Our total liability to you for any claim, regardless of the theory of liability (contract, tort, strict liability, or otherwise), is limited to the amount you actually paid to HomeReflect for the specific product or service that is the subject of the claim. This limitation applies to all damages collectively, including but not limited to direct, indirect, incidental, consequential, and punitive damages.

This liability limitation does not apply to: (1) death or personal injury caused by our gross negligence, (2) damages caused by our intentional misconduct, (3) violations of consumer protection laws where such limitations are prohibited, or (4) our obligations under the product warranty terms outlined above.

What We Take Responsibility For

We accept full responsibility for issues directly caused by our actions, products, or services:

  • Product Defects: Manufacturing flaws, material defects, or craftsmanship issues covered under our warranty terms
  • Service Failures: Our failure to deliver promised services, meet agreed timelines, or provide adequate customer support
  • Direct Damages: Actual costs you incur as a direct result of our mistakes, up to the amount you paid us
  • Shipping Issues: Damage during shipping when we arrange delivery, or loss of packages in our control
  • Data Security: Reasonable costs resulting from any security breach of your personal information in our systems

What We Cannot Be Responsible For

Certain types of damages are beyond our reasonable control or responsibility:

  • Indirect/Consequential Damages: Lost profits, business interruption, or other indirect costs not directly caused by our product
  • Installation Damage: Damage to your property during self-installation or installation by third parties not arranged by us
  • Misuse or Modification: Problems resulting from using the product outside its intended purpose or unauthorized modifications
  • Force Majeure: Delays or issues caused by natural disasters, pandemics, supply chain disruptions, or government actions
  • Third-Party Issues: Problems with internet service, smart home platforms, or other services not under our control
  • Normal Wear: Expected aging, wear and tear, or degradation over time with normal use

Privacy

Your privacy is paramount. Please review our Privacy Policy for details on how we handle your information.
